Immigration Legal Assessment
An Immigration Legal Assessment performed by
AMIS pvs comprises a number of steps.
Before we proceed with an assessment you
should review the steps below.
Please note,
the links provided to certain materials in this section
should not be relied upon as current or exhaustive links.
These links are provided solely to demonstrate some of the
concepts involved in a comprehensive immigration legal
assessment.
STEP 1
Taking as our starting point your objective,
being Temporary or Permanent residence (or a combination
of both) we select the classes of visa that may be
appropriate for you.
Visa
classes
are major groupings and comprise permanent and temporary
visa subclasses of a certain character.
STEP 2
Having selected the
visa
class or classes
we believe are most appropriate to your objectives we then
proceed to identify each
visa
subclass
from within those classes which we believe may be
appropriate.
STEP 3
Using the information you provide to us we
assess you against the requirements of each visa subclass
we have identified as appropriate and other materials
relating to your skills and experience. Skills and
experience are examined with reference to amongst other
things the
ASCO
Dictionary and the requirements of the relevant Australian
assessing authorities then compared with certain Gazetted lists such
as
MODL
and
SOL.
STEP 4
We further examine you against the relevant
legislative requirements such as the Schedules of the
Migration Regulations and other companion materials such
as the Procedures Advice Manuals and Migration Series
Instructions.
The
Schedules
prescribe the additional criteria you may need to satisfy
to be approved for a visa of a given subclass.
STEP 5
Finally we bring together the elements of our
assessment process into a written advice designed to focus
on the best match between your objectives, the information
you provide to us and the law and policy as they stand at
the time of our assessment.
If you do not provide
certain information to us or provide information that is
incomplete or inaccurate then our advice may be flawed.
